Terms of Use

These terms govern edtaxcredit.org (the "Site"), operated by Spark Learning, Inc. ("we," "us," or "our"). By using the Site after these terms are made available, you agree to them to the extent permitted by law. If you disagree, please stop using the Site.

Effective October 13, 2026

1Our role

Tax Credits for Education provides information about scholarship giving and education tax credits, including the Education Freedom Tax Credit or Federal Scholarship Tax Credit (EFTC/FSTC). We may introduce donors to independent scholarship granting organizations (SGOs) and philanthropic partners and support program-related fundraising.

We are not a government agency or IRS service and do not determine tax eligibility or award scholarships. Independent SGOs administer their programs and make decisions under applicable law.

2Educational information and tax eligibility

The Site, calculators, examples, emails, texts, and conversations with our team provide general educational information, not individualized tax, legal, financial, or accounting advice. Consult your own qualified adviser before contributing or claiming a credit. A calculator result is an estimate, not a determination or guarantee.

Eligibility depends on applicable law, the gift date and recipient, program requirements, and your circumstances. Qualifying federal contributions begin January 1, 2027. A gift to a philanthropic partner does not qualify merely because it works with us. Federal and state programs have different requirements.

Program rules, participating states, and eligible SGOs may change. A Site reference to an organization or a scholarship category is not a guarantee that a particular gift qualifies, that a credit is available, or that any specific student or school will receive funding.

3Interest forms and contributions

Submitting an interest form, selecting a scholarship preference, or indicating an amount you may give is not a donation, binding pledge, payment authorization, reservation of a tax credit, or commitment to contribute. You may decide whether to proceed after receiving more information.

A completed donation requires a separate process and your affirmative authorization. The donation page and recipient's terms govern the recipient, processing, fees, refunds, any recurring payments, and acknowledgment. These website terms do not authorize charges or establish a partner's refund policy.

A stated scholarship preference is an expression of interest unless the recipient expressly accepts a permitted restriction. It does not bind an SGO to fund a particular person, school, or outcome. Each SGO remains responsible for administering contributions and scholarships in accordance with law.

4Communications and privacy

Our Privacy Policy explains how we collect, use, and disclose information and how to exercise your choices. Agreeing to these terms does not by itself consent to partner marketing, text messages, automated calls, or advertising uses requiring separate consent. Your communication permissions and privacy choices control those activities.

5Text message program

If you separately opt in, Tax Credits for Education may send recurring automated texts about scholarship contributions, program updates, and opportunities to give to the number you provide. Consent is not a condition of making a contribution. Message frequency varies. Message and data rates may apply.

Reply STOP to opt out or HELP for help, or email info@edtaxcredit.org. A final nonpromotional confirmation of an opt-out may be sent where permitted. Please notify us if you change or relinquish your number. Message delivery depends on your carrier and device; carriers are not liable for delayed or undelivered messages. TCFE text permission does not authorize another organization's marketing texts.

6Acceptable use

Use the Site lawfully and provide accurate information when asking us to contact you. Do not impersonate another person, submit someone else's contact information without authority, send malicious code or spam, interfere with Site operation, attempt unauthorized access, or collect other people's information through the Site. We may restrict access when reasonably necessary to address misuse or protect the Site and its users.

7Content and third-party services

We or our licensors own the Site's content and branding. You may share public educational materials for lawful informational purposes, preserving attribution and notices without implying endorsement. Other rights are reserved, subject to permissions accompanying materials and rights available under law.

Links and introductions may lead to independent organizations, payment services, or other websites. Their own terms and privacy policies govern their services. We do not control their websites, scholarship decisions, or donation processing, and linking to them does not guarantee their performance or your tax treatment.

8Availability and limitations

We aim to keep information useful and accurate, but the Site may contain errors, become outdated, or be unavailable. To the extent permitted by law, the Site is provided as available without warranties of uninterrupted operation or fitness for a particular purpose. Nothing here excuses misleading statements or limits obligations that cannot lawfully be excluded.

To the extent permitted by law, Spark Learning, Inc. is not liable for indirect, incidental, special, or consequential losses arising from use of the Site. This limitation does not apply to fraud, willful misconduct, gross negligence, or liability that applicable law does not permit us to limit. These terms do not waive your statutory privacy or consumer rights.

9Changes and governing law

We may update these terms prospectively by posting a revised version and effective date. We will provide appropriate notice of material changes and obtain agreement where required. Updates do not retroactively change a completed donation or override existing privacy commitments. California law and applicable U.S. federal law govern these terms, without limiting mandatory protections available where you live. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
